Quantum: how federal requirements reach public bodies

We found no New York State or other state mandate for post-quantum cryptography. Federal requirements bind federal agencies, and reach state and local bodies and their suppliers in these ways:

Federal contracts

Executive Order 14412 directs a federal contracting rule requiring covered contractors to meet the federal encryption standards, including the post-quantum ones, by the end of 2030. The rule has not yet been proposed.

Federal funds

Grants and programs often carry federal security requirements. Watch for post-quantum terms in new awards and renewals.

Critical infrastructure

The same order asks federal sector agencies, working through CISA, to help critical-infrastructure operators such as water and wastewater utilities plan their migration.

Long-retention records

Public bodies keep records for years or permanently. Records that must stay confidential that long are the first to protect.
